Definitions

• The Photographer & Videographer / The Studio: To Love Studio and all related services

• The Client: Person(s) commissioning services

• The Services: Photography, videography, and related services

• Content: Photos and video content produced

Booking, Cancellation & Rescheduling

• Bookings are confirmed upon receipt of a signed agreement and deposit.

• Cancellations must be made in writing.

• If cancellation occurs within 30 days of the event, full payment is due.

• Rescheduling is subject to Studio availability and may incur additional fees.

Payment Policy

• All payments, including deposits (retainers), are non-refundable.

• In rare uncontrollable events (natural disasters, serious illness), and if full payment has been made, we may at our sole discretion offer a partial refund or credit. Such refunds are not guaranteed.

Communication & Client Responsibilities

• The Client is responsible for clearly communicating their expectations and requirements.

• The Studio is not liable for misunderstandings, miscommunications, or last-minute changes by the Client.

• Changes after signing may incur additional fees and/or delays.

• Clients must provide timely and clear instructions to avoid unmet expectations.

• The Client is responsible for securing permissions or releases from venues and guests if required.

Deliverables & Turnaround

• Deliverable timelines and quantities are specified in your contract.

• RAW files are only provided if pre-agreed.

• Additional deliverables outside the contract may incur fees and timeline extensions.

Revisions & Changes

• Small, limited revisions are accepted within 1 week of final delivery at the Studio’s discretion.

• Add-ons or changes after delivery or outside scope may incur fees and up to a 1-week extension.

• Revisions requested after 1 week may incur additional fees.

Complaints & Disputes

• Complaints must be submitted in writing via email to admin@tolove.com within 14 days of content delivery.

• We review complaints on a case-by-case basis and may dismiss those without contractual breach or Studio fault.

• Disputes will be resolved by negotiation or mediation before any legal action.

• Studio decisions on complaints are final unless otherwise required by law.

Intellectual Property & Usage

• To Love Studio retains full copyright of all Content.

• The Client receives a non-transferable, personal use license (e.g., social media sharing, personal printing).

• Commercial use requires explicit written permission.

Promotional Use & Likeness

• Upon signing a release form, the Client grants permission to use their likeness and Content for promotional purposes.

• If the Client later withdraws consent, the Studio will reasonably remove or cease usage, but this may not be immediate and is at Studio’s discretion.

• For ongoing campaigns, the Studio may retain usage rights until replacements are arranged.

Storage of Footage and Files

• Raw footage and files are stored for 3 months after final delivery.

• After 3 months, files may be deleted unless the Client requests extended storage in writing before the deadline.

• Extended storage may incur fees.

Limitation of Liability

• To Love Studio is not liable for indirect, incidental, consequential, or punitive damages.

• Liability for direct damages is limited to the amount paid by the Client for the Services.

• The Studio is not responsible for failure or delay due to events beyond reasonable control (force majeure).

Indemnity

• The Client indemnifies and holds harmless To Love Studio against claims arising from their use of the Content outside permitted uses.

Force Majeure

• Events beyond reasonable control (natural disasters, war, strikes, government actions) relieve Studio from liability or performance obligations.

• Deposits are non-refundable even in force majeure events unless otherwise agreed.

Termination

• Either party may terminate the agreement in writing.

• Outstanding payments for completed work remain payable.

• Upon termination, rights and obligations that survive termination continue in effect.

Governing Law & Jurisdiction

• This agreement is governed by the laws of the State of Western Australia.

• Parties submit to the exclusive jurisdiction of Western Australian courts.

Severability

• If any provision is invalid or unenforceable, the remainder of the agreement remains in effect.

Entire Agreement

• This contract, including any attachments, is the entire agreement between the parties and supersedes prior agreements.

Amendments

• Terms may be updated at any time with the latest version on the website.
